Work rights for spouses
Spousal Open Work Permit
Spousal open work permits were dramatically restricted in January 2025 — most spouses of students and many spouses of workers no longer qualify. Eligibility now turns on the principal applicant's program level or occupation and remaining permit time. We verify eligibility against the current rules before you file, and build the relationship and status evidence that carries the application.
Who it's for
- Spouses of workers in TEER 0 or 1 occupations, or eligible TEER 2/3 occupations
- Spouses of students in master's programs of 16+ months, doctoral, or eligible professional programs
- Spouses of principal applicants with at least 16 months remaining on their permit
- Partners sponsored inland for PR who qualify for the sponsorship-linked open permit
- Families whose SOWP renewal falls under the new rules after qualifying under the old ones
- Couples told they're ineligible who want the assessment verified before giving up
Common scenarios
Worker's spouse under the new rules
Your spouse works in Canada and you want to work too. We verify their occupation's TEER category against the current eligible list and the 16-month runway requirement before any application is filed.
Graduate student's spouse
Your spouse is starting a master's or doctoral program. We confirm the program meets the current criteria — level and length — and prepare the SOWP alongside or after their study permit.
Renewal under changed rules
Your current SOWP was issued under the old criteria and expires soon. We assess whether you can renew under transitional provisions or need a different status strategy entirely.
Evidence checklist
- Marriage certificate or 12+ months of cohabitation evidence for common-law partners
- The principal applicant's valid permit showing occupation or program and expiry date
- Evidence of the principal's occupation and TEER category: employment letter, pay stubs
- Proof of the student spouse's program level and length: enrolment letter, LOA
- Genuine relationship evidence: photos over time, communication, joint finances
- Both partners' passports and status documents
- Proof the principal has at least 16 months remaining, or the renewal in process
- Any previous SOWP and status history in Canada
Exact requirements vary by program and profile — treat this as a planning baseline, not advice on your specific file.
Process overview
Eligibility verification
We check the principal's occupation or program against the current eligibility lists and the remaining-duration requirement — the step where most 2025 refusals are born.
Relationship documentation
We build genuineness evidence to the standard officers apply, especially for recent marriages.
Application preparation
We assemble the SOWP application with a submission letter mapping your facts onto the current policy criteria explicitly.
Filing and contingency
We file, monitor, and — if eligibility fails — advise on alternatives: visitor status, the spouse's own permit routes, or PR strategy.
Risks & common mistakes
Applying under pre-2025 rules found in old blog posts and forums.
The January 2025 changes removed eligibility for most spouses of students and low/mid-TEER workers. Verify against current IRCC criteria, not cached advice.
Missing the 16-month remaining-duration requirement.
Spouses of eligible workers generally qualify only while the principal has at least 16 months left. Sequence the SOWP with the principal's extension when needed.
Thin relationship evidence on a recent marriage.
Open permits linked to relationships get genuineness scrutiny. Document the relationship's development, not just its certificate.
Assuming refusal of the SOWP is harmless.
A refusal enters your record and any misrepresentation finding poisons the family's future files. If eligibility is doubtful, resolve it before filing, not by filing.

Next step
Verify your SOWP eligibility before you spend the fee.
Every file starts with an honest assessment: what you qualify for, what the evidence needs to show, and what the realistic timeline looks like. We prepare the strongest possible application — and we're direct with you about risk, because the final decision on every application rests with the officer, never with us.
